21,400 New Authorities Are Stuck Waiting on Insurance
Overdrive counted more than 21,000 pending authority applications with no insurance on file. The clock that matters is 20 days from publication, and only your insurer can stop it.
21,400 applications stuck waiting on insurance
On September 25, 2026, Overdrive published a count that every new carrier should read before filing for authority. Pulling FMCSA's public Motus registration files on September 24, the writer found more than 22,000 operating authority applications sitting in Pending status. In 21,400 of them, or 95.4 percent, there was no required liability insurance filing on record. A month earlier, on August 23, the unfiled count was 16,606. That is a 28.7 percent jump in thirty days.
The numbers get worse the longer you look. Overdrive found that 3,648 of the pending applications had already passed the roughly 90 day window FMCSA describes before it dismisses an application, and another 1,798 had two weeks or less left. The median unfiled application had been waiting 41 days. Overdrive was careful to note that stale statuses left over from the May move to Motus inflate some of these counts, so treat it as a picture of the line, not a verdict on any one company. Still, the message is plain. Thousands of new authorities are stalled on the one piece the owner cannot file alone.
The real deadline is 20 days, not 90
A lot of new owner-operators plan around 90 days because that is the figure in FMCSA's FAQ. Overdrive pointed out that the regulation runs on a shorter clock. Once notice of your application publishes in the FMCSA Register, you get 20 days to have proof of insurance on file, and 20 days for the BOC-3 process agent filing. Miss that and FMCSA serves a decision warning that the application will be dismissed unless you comply within another 60 days.
That 60 day stretch is a rescue, not a plan. The clock starts at publication, not the day you hit submit, so anyone counting from their filing date is already behind. If the application does get dismissed, you refile under the same numbers and pay the $300 filing fee again. You cannot file your own proof of insurance
This is the part that trips people up. The BMC-91 or BMC-91X that proves your coverage to FMCSA has to be sent electronically by a registered filer, meaning your insurance company or a surety, never the carrier. So the fastest applicant in the world still waits on someone else's paperwork. The BMC-91 covers the whole required limit from one insurer, while the BMC-91X filing is used when the limit is built from more than one layer.
The federal minimum has not moved in decades. For-hire general freight in interstate commerce on trucks at 10,001 pounds GVWR or more needs $750,000 in commercial auto liability. Under 10,001 pounds it is $300,000, and hazmat runs $1 million or $5 million depending on the commodity. Brokers and shippers will usually ask for more than the minimum, and most loads also expect motor truck cargo coverage, so it pays to quote the whole package at once.
Two questions to ask before you bind
Overdrive's advice lines up with what we see every week. Have a quote ready to bind the day your docket number exists, then ask your agent two things. Who files my FMCSA filing, and how many business days after I bind until it shows up in the system? Every day of lag comes straight out of your 20.
A clean order of operations looks like this. Quote your insurance and pick a blanket BOC-3 agent a month before you apply. File in Motus and pay by card. The next business day, send your agent the USDOT and MC numbers and tell them to file. Watch for your publication date, because that is day zero. Ten days later, check your own record in Motus public search, and if the insurance or BOC-3 filing is missing, call FMCSA at 800-832-5660 rather than sending another email.
Why a slow filing costs more than time
A stalled application is not just a paperwork delay. Every week you are not active is a week the truck payment, the plates, and the insurance deposit keep coming due with no loads to pay for them. And a dismissed application sends you back to the start of the line with a second fee. The fix is simple. Line up coverage before you file so the insurance piece is never the thing holding you up. Common questions
How long do I have to get insurance on file for new authority
Under the regulation you have 20 days from the date notice of your application publishes in the FMCSA Register. If insurance is still missing, FMCSA serves a decision giving you another 60 days before dismissal. Plan against the 20 days, not the 90 day figure in the FAQ.
Can I file my own BMC-91 with FMCSA
No. The BMC-91 or BMC-91X must be sent electronically by a registered filer, which means your insurance company or a surety. Ask your agent who files it and how many business days it takes to show up in Motus.
What happens if my authority application is dismissed
A dismissal works like a rejection. You refile under the same USDOT and MC numbers through Motus and pay the $300 filing fee again. Get the insurance filing and BOC-3 in place before you refile so the same gap does not stall you twice.
How fast can I get a truck insurance quote for a new authority
Most new authorities can get a truck insurance quote the same day. Call or text 423-264-4255 or use the quote form, and have your USDOT number, MC number, and driver details handy so we can bind and file quickly.
