The Typical Truck Accident Settlement Is Now $2.15 Million. What That Means for Your Coverage

A new study of 334 truck accident cases shows the middle of the market moved, not just the nuclear verdicts. Here is what that means for an owner-operator's limits and premiums.

What the new report found

The U.S. Chamber of Commerce Institute for Legal Reform has released the second edition of its trucking litigation study, called Roadblock, and The Trucker reported on it October 19, 2026. The study looked at 334 truck accident verdicts and settlements from June 2023 through July 2026. The average award across all of them came to about $16.8 million. Plaintiff wins at trial averaged close to $28 million.

Those headline averages are pulled up by a handful of giant cases. The number that matters more to a one or two truck operation is the median, the middle case. According to The Trucker, the median settlement in the study was $2.15 million, the median plaintiff verdict was $5.2 million, and the median across verdicts and settlements together was about $2.99 million.

Most truck cases never reach a jury. They settle, and the typical settlement is what the new report says has climbed the most.

Why the median is the real story

The report itself notes that some averages came in lower than in the Chamber's last study, while the medians went up. That is a big shift. The first edition, which FleetOwner covered in August 2023, studied 154 cases from June 2020 to April 2023. Back then the median settlement was $210,000 and the combined median was $759,875.

In plain terms, nuclear verdicts still grab the headlines, but the ordinary case is the one that got more expensive. A typical settlement now sits well above the $750,000 federal minimum that a lot of new authorities start with. You do not need to be in a famous crash to have a claim that tests your limits. You just need a normal bad day and an injured person with a lawyer.

Where premiums come in

The same report ties those awards to what carriers pay for coverage. It says trucking liability premiums rose 37.8 percent from 2015 to 2024, faster than inflation, then climbed another 3.9 percent in 2025 to a record 10.6 cents per mile. The Chamber argues that smaller carriers feel this the most, and that the cost eventually lands on shippers and consumers too.

Keep in mind that the Chamber is a business group that pushes for tort reform, so its framing leans that way. The case counts and dollar figures are still useful, because they describe what insurers are paying out and pricing for. That pricing is a big part of how much commercial truck insurance costs for an owner-operator today.

Fraud and the push in Congress

The report also points to staged crashes as one driver of claims. It cites Operation Sideswipe in the New Orleans area, a scheme of deliberately caused crashes and false injury claims that led to charges against 63 defendants and more than 50 convictions. The Chamber is backing the Staged Accident Fraud Prevention Act, introduced in the Senate by Sen. Ashley Moody as a companion to H.R. 2662 from Reps. Mike Collins and Brandon Gill. The report also blames inflated medical billing, third party litigation funding and certain courtroom tactics for pushing awards higher.

Video, maintenance records and a clean driver file are the things that hold a settlement number down.

What an owner-operator can actually control

You cannot change how juries think, but you can change how your file looks when a claim lands. Settlement value goes up when the other side can paint a carrier as careless. It goes down when the records are clean.

  • Run a forward facing dashcam and save the footage after any incident, even a small one.
  • Keep your maintenance records, inspection reports and driver qualification file current and easy to hand over.
  • Report every accident to your insurer right away. Late notice makes defense harder and can hurt your claim.
  • At the scene, photograph everything, call it in, and leave the fault talk to the adjusters.
  • Look hard at your commercial auto liability limit. If the typical settlement is above your limit, the gap is your exposure.
